Clear operating terms
Terms and Conditions
These terms govern use of AstSer’s website and general business interactions. Service-specific agreements remain the controlling documents for paid work.
Last updated
Please read these terms before using the website or submitting information. By accessing the site, you agree to these terms to the extent permitted by law. If you act for an organization, you confirm that you are authorized to do so.
01
Scope and acceptance
These terms apply to AstSer websites, forms, content and general electronic communications. They do not replace a signed master services agreement, order, proposal, license, statement of work or service-level agreement.
If a specific agreement conflicts with these terms, that agreement controls for the relevant product or service.
02
Services, proposals and changes
Website descriptions are general information, not a binding offer, warranty or commitment. Scope, assumptions, dependencies, pricing, taxes, schedule, acceptance criteria and support are established in the applicable proposal or agreement.
Technology, availability and project conditions change. AstSer may update site content, correct errors or modify generally available offerings without creating an obligation for work not yet contracted.
03
Acceptable use
You may use the site only for lawful business and informational purposes.
- Do not attempt unauthorized access, testing, scanning, disruption or circumvention of security.
- Do not upload malicious code, impersonate another person or submit fraudulent or unlawful material.
- Do not scrape, overload, reverse engineer or automate access except where law or written permission allows it.
- Do not infringe privacy, intellectual property or other rights.
04
Intellectual property
AstSer and its licensors retain rights in site design, text, graphics, software, trademarks and other content. You may view and make limited internal copies for evaluating AstSer services, but may not republish, sell, modify or create derivative works without permission.
Customer deliverables, pre-existing materials, third-party components, open-source software and licenses are governed by the applicable project agreement and license terms. No rights are granted by implication.
05
Third-party products and links
AstSer integrates and refers to third-party products, open-source software, cloud platforms, maps, scheduling tools and external websites. Their availability, security, licensing and data practices are controlled by their providers. A link or integration does not mean AstSer controls or endorses every external statement.
You are responsible for reviewing applicable third-party terms. AstSer may recommend compatible technology, but provider changes outside our control may affect functionality.
06
Electronic communications, SMS and calls
You agree that requests, notices and records may be handled electronically where permitted. Contact information must be accurate and kept current.
SMS and call permissions offered on our forms are optional and separate. Message frequency varies and message or data rates may apply. Reply STOP to an AstSer SMS to opt out and HELP for help. You may withdraw call permission by contacting us. Consent is not a condition of purchase.
Submitting a telephone number alone is not consent to recurring promotional messages or automated marketing calls.
07
Customer responsibilities
For contracted services, the customer must provide timely access, accurate requirements, authorized contacts, safe work conditions, necessary decisions and permissions for systems, sites, data and third-party accounts. Delays or changes outside AstSer’s control may affect schedule and cost as described in the governing agreement.
Customers remain responsible for lawful instructions, backups unless explicitly included, end-user administration and their own compliance obligations.
08
Fees, taxes and payment
Any fees shown on the website are illustrative unless expressly stated otherwise. The signed quote, order or agreement sets currency, invoicing, deposits, expenses, taxes, payment due dates, renewal and cancellation terms.
Late, disputed or unpaid amounts are handled under the governing agreement and applicable law. Do not send payment-card information through a general contact form.
09
Disclaimers
The public website and its general content are provided on an “as available” basis. To the extent permitted by law, AstSer disclaims implied warranties relating to website content, including merchantability, fitness for a particular purpose and non-infringement.
Service warranties, remedies and support commitments—if any—are only those in the applicable agreement. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
10
Limitation of liability
To the extent permitted by law, AstSer is not liable for indirect, incidental, special, exemplary or consequential losses arising only from use of the public website, including lost profits, data or business interruption.
Liability for contracted services is governed by the applicable agreement. These limitations do not apply where prohibited or to liability that cannot legally be limited.
11
Suspension, governing law and changes
AstSer may restrict website access when reasonably necessary for security, abuse, law or protection of systems and users. Provisions that by nature should survive will continue.
Unless a signed agreement provides otherwise, these website terms are governed by the laws of the State of New York, without regard to conflict rules, and disputes relating solely to them will be brought in courts with jurisdiction in New York County.
We may update these terms. Continued use after the effective date means acceptance of the revised website terms to the extent permitted by law.
